About Divorce Mediation

MEDIATION is not one of the most frequently used methods of negotiating a divorce settlement yet it is the
MOST EFFECTIVE.

In divorce mediation, you and your spouse hire a neutral third party, called a Mediator, to meet with you in an effort to discuss and resolve the issues in your divorce. The Mediator is a facilitator to help you and your spouse arrive at a resolution based on your own ideas of what is fair in your situation, rather than having a solution imposed upon you based on rigid and impersonal legal principles as well as an impersonal, slow-moving and costly court system.  The Mediator helps you to develop a full and final agreement with respect to matters such as:

  • Division of marital assets

  • Division of marital debt

  • Retirement accounts and Qualified Domestic Relations Orders

  • Custody

  • Alimony

  • Child support

  • Other issues specific to your case

Why Try to Resolve a Divorce Through Mediation?

  • Avoid excessive legal fees. Mediation is far less expensive than a series of court conferences and court hearings

  • Mediation controls the outcome of the divorce process

  • Mediation ends in a settlement of ALL issues in your divorce

  • Mediation provides a settlement as to your divorce in a matter of weeks versus months or even years

  • Mediation avoids court appearances

  • Mediation takes a far lesser emotional and financial toll on you and your spouse

  • Mediation maintains civility for the sake of your children

Goals of Divorce Mediation

  • Create an equitable, legally sound and mutually acceptable divorce agreement

  • Avoid the heavy expense and trauma that often accompanies divorce litigation

  • Minimize hostility and post-divorce controversy

Who is the Mediator?

In many instances, a Mediator is not an attorney and not all attorneys are Mediators.  Here at divorcemediationpa.com your Mediator is an experienced, licensed attorney.  There is considerable advantage for a couple if the Mediator is an attorney because as an attorney, your Mediator knows what the courts will require of divorce agreements in order for them to be deemed acceptable. An experienced mediator who is an attorney is also better suited to interpret current Pennsylvania divorce law as it pertains to the issues the couples are mediating.

About Me

Michelle DaRe, Esquire

I have been a licensed and practicing attorney since 1997 in Pennsylvania, concentrating on Family Law with its vast array of issues, both simple and complex, and especially with both contested and uncontested divorces.  I found over the years that my clients who participated in divorce mediation process had similar if not the same outcomes as clients who went the route of months and years of divorce litigation, thus saving clients immeasurable emotional and financial damages as well as the tremendous stress that accompanies a traditional divorce.

Clients appreciate the relaxed environment of a mediation in their own homes and especially the total control they have over the outcome of their particular personal situation.  Further, the privacy is unparalleled and there is zero exposure to the impersonal and toxic court environment.
